A key witness, Curtis Mosley, 29, is gunned down and killed on Monday night.
Just hours before he was to testify in court, for an on-going case where he was shot in the leg.
At a hearing on Wednesday, prosecutors asked a judge for the OK to use the statements Mosley gave to police months ago.
This after presenting Judge Difanis with evidence of testimonies, from Mosley's mother and girlfriend, saying they witnessed the shooting and believe it's Ardis Fenn, 23.
Fenn is the same person who was charged in June 2012, with aggravated battery and discharge of a firearm--allegedly shooting Mosley in the leg.
Champaign County State's Attorney, Julia Rietz, gave us a statement:
"Judge Difanis ruled that based on the concept of forfeiture by wrongdoing, the prosecution would be allowed to present Mosley's statements to Urbana officers, as evidence in the trial."
