nation's highest court. At issue? Concealed carry in Illinois.
On Tuesday, a federal court ruled
the state's ban on concealed weapons is unconstitutional, and ordered
state legislators to draft a law allowing citizens to carry guns. But
there may be a fight brewing.
Illinois Attorney General Lisa
Madigan's office said she is studying the issue, which may include an
appeal to the U.S. Supreme Court.
We spoke to Springfield attorney John Gray Noll, and asked him what he foresees the next steps will be.
"I think if I were sitting where the attorney general is sitting, I would petition the court for a re-hearing en banc,"
Noll said. "That, I believe, is the state of Illinois' best chance to
win this, to have it overturned, have it reconsidered by the court."
In essence, the term en banc
is a French legal term meaning a case to be heard before all judges. In
this case, that would mean all 10 federal appellate judges would
re-hear the case, instead of only the three judges who struck down the
concealed carry ban.
Quinn, who opposes concealed carry, will
insist that any law allowing the right to carry include reasonable
restrictions, such as banning people with a history of mental illness
from having weapons.
